1. Unacceptable Use
90 Seconds requires that you and all our other customers and users of our services (the “Services”) conduct yourselves with respect for others. In particular, please observe the following rules in your use of the Services:
1.1 Abusive Behavior.
Do not harass, threaten, or defame any person or entity. Do not contact any person who has requested no further contact. Do not use ethnic or religious slurs against any person or group.
1.2 Privacy.
Do not violate the privacy rights of any person. Do not collect or disclose (i) any personal address, social security number, identification number, or any other personally identifiable information or (ii) sensitive personal information including medical history, sexual orientation without the person’s consent. Do not co-operate in or facilitate identity theft
1.3 Restricted Materials.
Do not upload pornographic, child exploitation, racist, defamatory, seditious, extremist propaganda or any other offensive materials to the Platform.
1.4 Intellectual Property.
Do not infringe upon the copyrights, trademarks, trade secrets, or other intellectual property rights of any person or entity. Do not upload to the Platform, reproduce, publish or communicate to the public software, audio and video recordings, photographs, articles, or other works without the written permission of the copyright holder.
1.5 Hacking, Viruses and Network Attacks.
Do not access any computer or communications system without authorization, including the systems used to provide the Services. Do not intentionally distribute a computer virus, launch a denial of service attack, or in any other way attempt to interfere with the functioning of our Platform, any computer, communications system, or website. Do not attempt to access or otherwise interfere with the accounts of other users of the Services.
1.6 Spam.
Do not send bulk unsolicited emails or sell or market any product or service advertised by or connected with spam. Do not facilitate or cooperate in the dissemination of spam in any way.
1.7 Fraud.
Do not issue fraudulent offers to sell or buy products, services, or investments. Do not mislead anyone about the details or nature of a commercial transaction. Do not commit fraud in any other way.
1.8 Violations of Law.
Do not violate any law, regulation or governmental policy.
2. Consequences of Violation
Violation of this Acceptable Use Policy (“AUP”) may lead to suspension or termination of your account or legal action. Where illegal or infringing material has been uploaded to or reproduced on the Platform, we will cooperate fully with all law enforcement investigations. In addition, you may be required to pay for the costs of our investigation and remedial action in relation to AUP violations. We reserve the right to take any other remedial action we may be entitled to.
3. Reporting Unacceptable Use
90 Seconds requests that anyone with information about a violation of this AUP report it via e-mail to legal@90seconds.com. Please provide the date and time (with time zone) of the violation and any identifying information regarding the violator, including e-mail or IP address if available, as well as details of the violation.
4. Disclaimer of Responsibility
90 Seconds is under no duty to monitor or police each customer’s or user’s activities on our Platform to determine if a violation of the AUP occurred. We disclaim any responsibility for such inappropriate use and any liability to any person for any other person’s violation of this AUP.
5. Amendment of AUP
We may change this AUP at any time by posting a new version on this page and sending you written notice of such change. The new version shall be effective from the next business day of such notice.
